Policy and Procedure


Consumer Abuse and Neglect:  Zero-Tolerance

Policy


Alliance of Abilities, Integrity House, and Harbor House will report all observed, known, or suspected cases of member abuse in accordance with state and local laws, statutes, code, regulations, etc.

Abuse is defined as: any willful act which endangers an individual’s physical, mental, and emotional well-being.  This includes, but is not limited to, physical assault, mental suffering, sexual assault, misappropriation of funds, neglect, and abandonment.

Procedure

ALL observed, known, or suspected incidents of abuse perpetrated upon a member will be reported to Adult Protective Services of Orange County (800-451-5155) as soon as practically possible.  A follow-up written report, using the Report of Suspected Dependent Adult Abuse (SOC 341), www.dss.cahwnet.gov/Forms/English/SOC341.pdf, will be sent to Social Services Agency/APS at P.O. Box 22006, Santa Ana, CA 92702-2006 or FAX: 714-704-6161within two (2) working days.  A duplicate copy will be filed in the  member’s case file.

Staff, upon becoming aware of a reportable incident or allegation of abuse or neglect, will take immediate action to ensure the health and safety of the involved member and all other members in given clubhouse.

Alliance of Abilities will inform all employees upon hire and annually thereafter of the Zero-Tolerance Policy: Consumer Abuse and Neglect.

Failure to follow this policy is a misdemeanor, punishable by not more than six months in the county jail, or by a fine of not more than $1,000, or by both imprisonment and fine. Any mandated reporter who willfully fails to report abuse of an elder or a dependent adult, where the abuse results in death or great bodily injury, may be punished by up to one year in the county jail, or by a fine of up to $5,000, or by both imprisonment and fine.

This policy and Procedure will be posted on the Alliance of Abilities’ web site and sent to all members, their families and any vendors who provide services to our members on an annual basis.
